Wills and probate
It is crucial to make a will to avoid dieing intestate or a living will in case you may get ill and do not wish to receive certain medical treatment. When a person dies, someone has to administer the deceased’s estate and for him/her to do so, s/he has to obtain a grant of representation. You can only challenge the grant of probate within six months of the date of death in contentious probate cases where (a) the will was made without capacity or under duress; (b) the estate is distributed against the wishes of the deceased; (c) a person has died intestate and you as a family member has been excluded; or (d) where the will has excluded you, though you ought to have been entitled to the legacy.
